NYASHA Tayiya, the director of Cool Times Ice Cream has bee acquitted of rape and is a free man.
Magistrate Takudzwa Gwazemba said in his ruling there had been no evidence since police did not do their work.
He also said the complainant fabricated the story since she did not voluntarily disclose the alleged rape and that she reported days after the sexual encounter.
Gwazemba also said the defence witnesses corroborated with Tayiya’s statements leaving the court convinced there was no rape.
The ruling was made Friday ending a long trial in which Tayiya denied the allegations from the onset.
The highlight and turn of the matter was when the investigating officer from Beitbridge Rural Police Station one Caswell Mutsara’s display when called to give evidence.
He simply told the court that he did not investigate because it was dark.
Tayiya had been accused of rape of his live-in employee, a charge he repeatedly denied as false, fabricated and influenced.
