Trymore Madakuenda, a 48-year-old man from Chikanga Mutare, has been convicted of Culpable Homicide by the Mutare Magistrates’ Court after a reckless driving incident resulted in the deaths of two pedestrians.
The incident occurred on the evening of January 8, 2024, around 7:30 PM, along the Harare-Mutare road at Christmas Pass.
According to the prosecution, Madakuenda was speeding in his Nissan NP300 when he struck two individuals who were crossing the road. Both victims sustained severe head injuries and broken legs and tragically died at the scene.
The prosecution outlined several acts of negligence that contributed to the fatal accident.
They highlighted Madakuenda’s failure to keep a proper lookout, excessive speed, and a lack of reasonable action when the collision seemed imminent. Furthermore, it was noted that he did not sound his horn, which could have alerted the pedestrians of his approach.
After deliberations, the magistrate handed down a sentence of a USD 400 fine, with a two-month imprisonment term as an alternative if the fine is not paid.
Additionally, a further two months of imprisonment were suspended on the condition that Madakuenda does not commit a similar offense within the next five years.
