Beitbridge– Three Zimbabwe Republic Police (ZRP) officers who stand accused of raping the same victim on separate days using the same modus operandi have been remanded in custody to the 23rd of July 2024.
The trio, Courage Majoni, Jabulani Museba and Enock Nyamupandu all stationed at Chitulipasi Post Camp are being charged with rape as defined in section 65 of the Criminal Law Codification and Reform Act Chapter 9:23.
In the state’s case, allegations against Courage Majoni are that at Chitulipasi police post camp quarters, Beitbridge on the 8th day of June 2024 at around 1800 hours the accused entered into a bathroom where the complainant was bathing, whilst in the bathroom, the accused grabbed the complainant’s neck, closed her mouth, threatened to kill her if she tell anyone about what he was going to do. After threatening the complainant, the accused person who was already wearing a condom removed his short, made the complainant to lie on the floor, went on top of her, opened her legs, inserted his penis into complainant’s vagina and had sexual intercourse with the complainant once without her consent and raped her once. On the 29 day of June 2024, the complainant revealed the matter to her mother who then accompanied her to ZRP West Commonage where she reported the matter.
On the case against Jabulani Maseba, the state alleges that on the 5th day of June 2024 at around 1800 hours and at Chitulipasi Post camp quarters, the accused person sneaked into a bathroom where the complainant was bathing. Whilst in the bathroom, the accused grabbed the complainant from behind, closed her mouth using his hands, pushed her to the floor, threatened to shoot her if she reveal what he was going to do. The accused person then lowered his trousers and was already wearing a condom on his penis, went on top of the complainant, inserted his penis into her vagina and had sexual intercourse with the complainant once without her consent. On the 29th day of June 2024, the complainant revealed the matter to her mother who then accompanied her to ZRP west commonage where she reported the matter.
In the last case pitting the state against Enock Nyamupandu, the state also alleges on the 13th of June 2024 at around 1400 hours and at Chitulipasi Post camp quarters, the accused invited the complainant to collect her plates which were in one of the rooms where police officers keep their food stuffs, as soon as the complainant entered into the room, the accused person immediately closed the door from behind, picked a kitchen knife, threatened to kill the complainant and her aunt whom she was staying with by that time. The accused person then removed his trousers, wore a condom whilst complainant was standing, pushed the complainant to the bed, removed her trousers and pant, went on top of her, inserted his penis into complainant’s vagina and had sexual intercourse with her once without her consent. On the 29 day of June 2024, the complainant revealed the matter to her mother who then accompanied her to ZRP West Commonage where she reported the matter.
The trio are being represented by Muchihwande Sithole of Chauke and Associates and are further remanded to the 23rd of July for trial whilst their bail can be heard as soon as their bail can be actioned any time the or on such a time when the bail order is attained from the Prosecutor General’s head office in Harare.
