THE High Court has granted bail to Beitbridge activist Bhekimpilo Mbedzi after allowing his appeal against a Beitbridge Magistrates Court decision that had denied him bail pending trial.
Justice Dube-Banda, sitting in Masvingo, ruled that the lower court had misdirected itself and held that the interests of justice favoured Mbedzi’s release on bail.
The judge found that the State’s fears that Mbedzi would interfere with witnesses, commit similar offences or undermine the administration of justice could be adequately addressed through appropriate bail conditions.
“The appeal has merit, and there is a legal basis to interfere with the exercise of discretion by the lower court,” ruled Dube-Banda.
The High Court admitted Mbedzi to bail on the following conditions:
He shall deposit US$200 with the Clerk of Court at Beitbridge Magistrates Court.
He shall reside at 2044 Dulibadzimo, Beitbridge, until the matter is finalised.
He shall surrender his passport to the Clerk of Court at Beitbridge Magistrates Court.
He shall report to Beitbridge Police Station, every Monday and Friday, until the matter is finalised.
He shall not interfere with State witnesses or police investigations.
Mbedzi is facing trial at the Beitbridge Magistrates Court on allegations of contravening provisions of the Maintenance of Peace and Order Act.
